About My Sound

These Terms and Conditions (“Terms”) govern your use of About My Sound (“we,” “us,” or “our”). By using our website or services, you agree to these Terms.
1. Our Service
About My Sound is a platform that helps musicians and bands create and manage artist websites, pages, and related features such as mailing list collection, show listings, ticket links, electronic press kits (EPKs), and embedded media.
We may change, update, suspend, or discontinue features at any time.
2. Accounts
To use some features, you may need to create an account. You agree to:
- Provide accurate information
- Keep your login details secure
- Be responsible for activity under your account
- Notify us if you suspect unauthorized access
We may suspend or terminate accounts that violate these Terms or pose a legal, security, or operational risk to the platform or other users.
3. Your Content
You retain ownership of the content you upload or submit, including text, images, videos, links, event details, EPK materials, and artist information.
By uploading content to About My Sound, you grant us a limited license to host, store, display, reproduce, and distribute that content only as needed to operate and provide the service.
You are responsible for making sure you have the rights to upload and publish all content you use on the platform.
4. Public Pages and Fan Data
Some content you create may be publicly visible. This can include artist pages, bios, EPK pages, images, videos, quick links, and show information.
If you collect fan email addresses or other fan data through your artist page, you are responsible for using that information lawfully and with proper consent where required, including compliance with Canada’s Anti-Spam Legislation (CASL) and any other applicable privacy or marketing laws.
5. Payments, Subscriptions, and Fees
Some features may require a paid plan or subscription. If you subscribe to a paid plan:
- You authorize us and our payment provider to charge your payment method for applicable fees
- Subscription fees may be recurring unless canceled
- Fees may change in the future, and we will give notice where required
- Refunds, if any, are provided only according to our posted refund terms or applicable law
If you use ticketing or payment-related features, you understand that third-party payment processors may be involved and that their own terms may also apply. Artists who connect a Stripe account for ticketing or payment purposes are subject to Stripe’s Connected Account Agreement and any related Stripe terms of service.
6. Ticketing and Event Information
If you create or publish shows, you are responsible for:
- The accuracy of show details, including title, description, date, and URL
- Pricing, capacity, and ticket availability
- Any promises you make to buyers or fans
- Compliance with applicable laws, taxes, and consumer requirements
We are not responsible for disputes between you and your event attendees, except where required by law.
7. Acceptable Use
You agree not to use About My Sound to:
- Break the law
- Infringe copyright or other rights
- Upload harmful, abusive, or fraudulent content
- Interfere with the platform or other users
- Attempt unauthorized access to accounts or systems
- Send spam or misleading communications
- Misrepresent your identity or your content
- Use the platform in a way that could damage our systems, users, or reputation
8. Third-Party Services
About My Sound may connect to third-party services such as payment providers (including Stripe and Stripe Connect), email services, analytics tools, and Google sign-in.
We are not responsible for third-party services, their content, their privacy practices, or their availability. Your use of those services may be governed by their own terms.
9. Intellectual Property
Our platform, branding, design, code, and underlying software are owned by us or our licensors and are protected by intellectual property laws.
You may not copy, reverse engineer, resell, or exploit our platform except as expressly permitted by us.
10. Termination
You may stop using About My Sound at any time. We may suspend or terminate your access if:
- You violate these Terms
- Your use poses a legal, security, or operational risk
- We are required to do so by law
- We discontinue the service
11. Disclaimer
About My Sound is provided on an “as is” and “as available” basis. We do not guarantee that the service will always be uninterrupted, error-free, or suitable for every purpose.
12. Limitation of Liability
To the fullest extent permitted by law, About My Sound will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost opportunities.
To the fullest extent permitted by law, our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim arose, or the minimum amount allowed by law, whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, and expenses arising from:
- Your content
- Your use of the service
- Your violation of these Terms
- Your violation of any law or third-party right
14. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will post an updated version on this page and update the effective date.
15. Governing Law
These Terms are governed by the laws of Ontario, Canada, unless local law requires otherwise.
